Samoa Compensation Laws
You must compensate employees no more than one week after the pay period ends. Unless requested by an employee, all compensation should be in Samoan tālā. If you have written consent, you can pay employees through:
- Other currencies.
- Direct deposit.
- Check or money order.
The minimum wage for workers in the private sector is 3 tālā per hour. In the public sector, workers are entitled to at least 4 tālā per hour. Hourly wages do not apply to those employed in piece work, who you pay per task.
Employees have the right to bargain under collective agreements, and wages often fall under negotiable terms.
You should keep documentation of your employees’ compensation as the Chief Executive Officer (CEO) of the Ministry of Commerce, Industry, and Labor can request these records at any time.
You are required to choose a private insurance carrier for accident and work-related injury insurance. Then, you must withhold one percent of employees’ salaries for injuries unrelated to work. You match this contribution, and both payments fund compensation for work-related injuries.
Insured employees receive various benefits through social security, too, including:
- Old-age pensions.
- Senior citizen benefits.
- Permanent disability benefits.
- Survivor pensions.
- Death benefits.
Restrictions on Benefits and Compensation
The 2013 Labor and Employment Relations Act and the 2016 Labor and Employment Relations Regulations outline various minimum standards for benefits and compensation. This allows you to better the terms if you choose.
Social security provides monetary compensation in several circumstances, including disability, retirement, and death. However, employees who take sick and maternity leave only benefit from free medical care at government health care facilities.
