Laws against discrimination in Togo

Companies must ensure all employees receive the right freedoms and protections under the law while recruiting and after. Some laws include protections pertaining to:

  • Sexual harassment: This is illegal and can be prosecuted in court, although there is no specific length of punishment.
  • Discrimination against women: Although women and men are equal under the law, many women still experience discrimination related to education, pay, inheritance, and pension benefits. However, there are no restrictions against women signing contracts, opening bank accounts, or owning property.
  • Discrimination against individuals with disabilities: The law prohibits any type of discrimination against someone with a physical, mental, intellectual, or sensory disability. However, it does not mandate specific accessibility to public or private facilities.
  • Discrimination against individuals with HIV/AIDS: Anyone with HIV/AIDS cannot be discriminated against, and the country has government-sponsored broadcasts aimed at eliminating this type of discrimination.
  • Employment of children: Any child under 15 cannot work in any enterprise or type of work. Children younger than 18 cannot work at night, and all working children need a daily rest period of at least 12 hours.

How to hire employees in Togo

Employees in Togo should all have oral or written employment contracts in French, but we recommend a strong written contract. You should incorporate important terms like compensation, benefits, termination terms, working hours, overtime, and similar elements. Use Togo’s currency, West African CFA Francs, for all salary and compensation amounts in your contract.

Togo employment laws

Togo employees normally work 40 hours per week. Any working hours over that number are considered overtime — employees may be required to work extra hours if there’s an emergency or exceptional situation. The Collective Interprofessional Agreement sets overtime pay at these rates:

  • 41–48 hours: 20% of the employee’s hourly wage
  • Over 48 hours: 40% of the employee’s hourly wage
  • Sundays and holidays: 65% of the employee’s normal pay

Onboarding in Togo

Onboarding employees is a necessary but complicated task. The process is ultimately up to companies, but you should try to include steps that make your new hires comfortable with each other and their new positions. Make sure each employee signs the employment contract and agrees to all the terms.
