Employment Contracts in Namibia

Fixed term contracts are permitted.

It is legally required to put a written employment contract in place in Namibia, in the local language, which spells out the terms of the employee’s compensation, benefits, and termination requirements. An offer letter and employment contract in Namibia should always state the salary and any compensation amounts in Namibian dollars rather than a foreign currency.

Working Hours in Namibia

In general, the work week should not exceed 45 hours, and overtime should not exceed 10 hours per week.

Vacation Days in Namibia

Employees are generally entitled to 24 consecutive days of paid annual leave.

Namibia Sick Leave

Employees generally receive one day of sick leave for every five weeks of work during the first year of employment. Thereafter, employees are entitled to 30 days of annual sick leave, or 36 if they work six day weeks. Employees must submit a medical certificate.

Maternity/Paternity Leave in Namibia

Female employees are generally entitled to four weeks of maternity leave before the birth and eight weeks after.

There is no statutory paternity leave.

Health Insurance in Namibia

Namibia has a public/private healthcare system. According to the Africa Health Observatory, 85% of the population uses the public system, while the 15% of the population who are middle class and upper class use private healthcare. Private insurance is available for out of pocket expenses.

Termination/Severance in Namibia

In general, employees who have been terminated for just cause are entitled to the following notice periods:

  • less than four weeks service: one day’s notice
  • more than four weeks service but less than one year: one week’s notice
  • more than one year’s service: one month’s notice

Employees who have worked for at least 12 months are generally entitled to severance pay.

Paying Taxes in Namibia

Employers and employees both contribute to social security with a 50/50 split. Contributions are generally 0.9% of earnings with a minimum monthly contribution of N$2.70 and a maximum of N$81.00 by each party.
